Mr. Copeland "TsTech" as he's come to been called thinks that he has the right to tell people that they can't use Bersirc 1.4, a source that he did not code, but rather bought. Now, on the installation of Bersirc 1.4 (which is freely distributed on his site) the license perfectly shows that you are making an agreement been yourself and Jamie Frater. In no part of this license does it say "Mr. Copelan". Do you feel that he has the right to tell people that you can't use an IRC client that I have been using wayyyyy longer than the person who now owns it?

License:

Quote:
END USER LICENSE AGREEMENT FOR BERSIRC BINARIES AND/OR SOURCE CODE

1. GENERAL USE LICENSE
This end-user license agreement (EULA) is a binding legal agreement between you and Jamie Frater and applies to BERSIRC, which includes all SOFTWARE and documentation as contained in the distribution package provided by Jamie Frater.

IF YOU DO NOT AGREE WITH THIS EULA, DELETE THE APPLICATION PACKAGE PROVIDED TO YOU.

2. SOFTWARE USE
YOU ARE BOUND BY, AND INDICATE YOUR EXPLICIT ACCEPTANCE OF THE TERMS AND CONDITIONS OF THIS AGREEMENT UPON PROCEEDING WITH THE INSTALLATION OF THIS PACKAGE.

N.Z AND INTERNATIONAL COPYRIGHT LAWS AND TREATIES, TO INCLUDE ALL INTELLECTUAL PROPERTY LAWS AND TREATIES, PROTECT THIS SOFTWARE.

2. SOURCE CODE USE
Source code purchased from Jamie Frater may be freely modified and recompiled binaries may be redistributed freely. YOU MAY NOT DISTRIBUTE ANY DERIVATIVE FORMS OF THE SOURCE CODE PURCHASED OR ANY PARTS THEREOF. JAMIE FRATER RETAINS FULL RIGHTS TO ANY PURCHASED SOURCE CODE AND DERIVATIVES THEREOF.

JAMIE FRATER PROVIDES NO GUARANTEE THAT PURCHASED SOURCE CODE WILL COMPILE, OR THAT ADDITIONAL LIBRARIES NEED NOT BE PURCHASED. YOU MUST PURCHASE ANY ADDITIONAL LIBRARIES OR SOURCE LICENSED BY JAMIE FRATER FROM THE ORIGINAL VENDOR. THIS LICENSE INCLUDES NO PROMISE OF SUPPORT OR DOCUMENTATION FOR SOURCE CODE PURCHASED.

YOU AGGREE, THAT JAMIE FRATER IS NOT RESPONSIBLE FOR ANY AND ALL DAMAGES WORN BY THIRD PARTIES AS A RESULT OF BINARIES PRODUCED FROM THIS SOURCE CODE, OR DERIVATIVES THEREOF.

3. LICENSE EXCLUSIONS. Under your license you:

4. TERMINATION OF LICENSE
Unauthorised distribution of source Code or portions thereof is a crime. In addition to prosecution to the fullest extent of both civil and criminal laws, users found in violation of any stipulation of this EULA will have their license to this SOFTWARE and source code permanently revoked.

5. STORAGE AND DISTRIBUTION
You may store and make available for electronic download, the original binary package, in an unmodified form, as provided by Jamie Frater, notwithstanding exclusions stated hereinbefore.

6. DE-COMPILATION AND REVERSE ENGINEERING.
You agree not to make any attempts to de-compile, reverse engineer, or disassemble the executable portions of the SOFTWARE to avoid the requirement to modify copyright displays, or the operational aspects of the SOFTWARE.

[05:37] <null> TsTech: tell me your real name then...because ive been on contact with James, for a long time...over alot of bersirc incidents, including his website
[05:37] <null> And to be honest, you dont match the ip i have of his.
[05:37] <Dilpo> who owns bersirc?
[05:37] <Dilpo> man that thing needs a new name
[05:37] <Dilpo> like
[05:38] <TsTech> I'm Nicholas Copeland. I purchased Bersirc from Jamie Frater in February of 2004.

[05:39] <Dilpo> oh bitch
[05:39] <Dilpo> owned
[05:39] <null> still owned by jamie frater at the time of download and install
[05:39] <null> which means..
[05:39] <Dilpo> owned
[05:39] <null> he has rightsd to use that version
[05:39] <null> Especially since his version reply, shows " Jamie Frater "
[05:40] <null> And as does yours.
[05:40] <null> so, if you bought it, wouldnt you change the version ?
[05:40] <TsTech> Incorrect. He's using using proprietary, closed source software, owned by me.
[05:40] <null> I disagree....
[05:40] <null> bersirc.free2code.net shows...
[05:40] <null> CLEARLY
[05:40] <TsTech> Why? If you understood the nature of Bersirc, you would understand.
[05:40] <null> " BERSIRC OPEN SOURCE IRC "
[05:40] <Dilpo> You sound like a !@#$@#! robot. ***************[05:40] <null> OpenSource !
[05:41] <TsTech> null: Read the FAQ. Bersirc 2.1 is Open Source, Bersirc 1.4 remains closed.
[05:41] <TsTech> Also read the news posting, "All future versions will be open source"
[05:41] <Dilpo> http://www.tomservo.cc/show.aspx/ratsass.gif
[05:41] <Dilpo> thats all i have to say
[05:41] <null> lol
[05:42] <null> so your ordering people NOT to use your own software anymore ?
[05:42] <TsTech> Just alex.
[05:42] <Dilpo> i say let him take it to court
[05:42] <null> lol !!!!
[05:42] <null> Theres honestly nothing you can do to stop him
[05:42] <null> Believe me
[05:42] <TsTech> Yes there is, believe me.
[05:42] <TsTech> I take IP law very seriously.
[05:42] <null> At the time of download, and install upon his system, that version was owned by Jamie Frater, and currently free to all to use...
[05:43] <null> Any future contracts AFTER " purchase " or download..
[05:43] <null> Are therefor not included and have no effect.
[05:43] <TsTech> time of download doesn't mean shit. It's LICENSED, and licenses can be revoked.
[05:43] <null> Im partial lawyer...so dont get involved in laws
[05:43] <Dilpo> i thin TsTech just got owned like this guy http://www.tomservo.cc/show.aspx/ouch-redlight.jpg

Quite random for him to just get on my network and tell me that I can't use "his" application. Especially since i've been using it well before he even used the application in the first place.

I'd either ignored him .. or tell him to sue me (of course refusing to give any of my personal info) .. depending on my mood.
