| I was made aware that there is a java based ircx server, known as TESX, and I am interested in possibly picking it up and continuing the development of it. My only problem is, I can't seem to find the creator of it to ask for permission to do so. While I am sure he probably wouldn't mind his creation being continued, I still would rather have his permission. I believe his name is David Forrest. If anyone knows where I can find him or contact him, it would be appreciated if you could either let me know, or forward this on to him, and provide him with my email address, chaosinc@sssnet.com |

TESX is GPL licensed, so the creator can not legally stop you from continuing development so long as you adhere to conditions of the GPL license agreement.
The above website seems to have an email address, but I can't confirm the email address is valid. |

| I undertand the desire to obtain permission, however since you can't, please take comfort in the fact that you can still continue development legally even without his permission and even if he *does* mind. |

| Good point. Unlike many others though, I prefer asking permission, as I don't like to just take things and revive them or even use them without that authority. At least I can say that I tried first, and he was no where to be found, and if it comes to it, at least I can easily just put a stop to doing it if he ever comes back. |

| We could definitely use that Anarchy. It would be much appreciated. Also, if anyone is familiar with TESX, and have a great deal of knowledge about TESX, it would be appreciated if you could report any bugs you know of. Also, if you have a server or network running TESX, it would be great if you'd give your suggestions of new features or any changes you would like to see. |

That's the whole point behind GPL, Open Source projects is to allow multiple versions of code to be written and used without licensing conflicts. You *HAVE* the authority already. It's granted by the GPL license. The author can not legally tell you "no".
I understand you wanting permission and that's completely your choice. I'm wanting you to understand that in the event you don't or can't obtain it, there is no legal or moral reason you must stop development, even if that developer tells you to stop, you don't have to. You are legally protected by the GPL license and said developer can not force you to stop so long as you adhere to the license agreement, more details can be found at http://www.gnu.org/ |

Wrong. The GPL license only applies in the context of a copyright license. The copyright owner reserves the right to revoke a license at any time, especially if they feel that the use of the materials is harmful to their reputation or is causing punitive damages. See USC 17 ยง 203 for more information. |
